Privacy Policy
Through this Policy, it is informed that the personal data of Fairplay Golf & Spa Resort customers, owned by NUEVAS INICIATIVAS SOCIALES, S.L. (hereinafter NIS) will be processed in accordance with the principles of transparency, purpose limitation, data minimization, accuracy, integrity, and confidentiality, as well as respecting the rest of the obligations and guarantees established in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.
For this purpose, we have updated our Privacy Policy, which affects individuals and interlocutors of companies, and replaces the previous one that regulated the processing of our clients’ data, with the aim of renewing customer trust and offering them special treatment.
In order to comply with the aforementioned regulations and help the client of any Product or Service of NIS to understand how their personal data are collected, used, processed, and protected, we inform you of the following aspects related to your right to data protection.
1. Who processes your data?
The following companies of the business group will be jointly responsible for processing the personal data of the Client based on the products and services contracted.

2. What data do we process?
NIS will process the following categories of user data:
- Data provided for the making of individual, group, or meeting room/event reservations, both through the Website and through our Reservations Department by email, chat, or phone.
- Identification data: name, last name, nationality.
- Contact information: email address, phone number.
- Stay preferences.
- Other data: data provided by the interested parties in open fields or through the call made.
- Data provided for the modification and cancellation of reservations:
- Identification data: name, last name.
- Contact information: email address, phone number.
- Goods and services transaction data.
- Other data: data provided by the interested parties in the open fields of the forms provided on the Website or in the attached documents.
- Data provided for Newsletter subscriptions:
- Identification data: name, last name.
- Contact information: country of residence, email address.
- Personal characteristics data: language.
- Data provided in contact forms and website
- Identification data: name, last name.
- Contact information: email address, phone number.
- Goods and services transaction data at NIS.
- Economic, financial, and insurance data.
- Other data: data provided by the interested parties in the open fields of the forms provided on the Website or in the attached documents.
3. Why do we process your data?
- For making reservations, through the Website or the Reservations Department for individual or group reservations and meeting rooms: execution of the contract between the parties. For the execution of analysis on the use of the website, NIS’s legitimate interest.
4. Information retention periods
The client is informed that, in compliance with the principle of limited retention period, the collected data will be processed only for the time necessary and for the purposes for which they were collected at all times. They will therefore be kept in a way that allows the identification of the interested parties for no longer than necessary for the purposes of the processing of personal data.
- Client data: the data will be kept during the validity of the contractual relationship plus an additional maximum period of 8 years after the termination of the contract, in application of the Civil Code and tax regulations.
- NIS Products or Services data: the data will be kept during the validity of the contractual relationship plus an additional maximum period of 8 years after the termination of the contract, in application of the Civil Code and tax regulations.
5. Exercise of rights
In accordance with the applicable regulations, NIS informs the client that they have the following rights derived from the applicable regulations:
- Access: allows the data subject to obtain information on whether we are processing personal data concerning them at NIS and, in that case, the right to obtain information about your personal data undergoing processing.
Rectification: allows correcting errors and modifying data that are found to be inaccurate or incomplete.
- Erasure: allows data to be deleted and no longer processed by NIS, unless there is a legal obligation to keep them and/or other legitimate reasons for their processing by NIS prevail. For example, when personal data are no longer necessary for the purposes for which they were collected, the client may request that we delete this data without undue delay.
- Restriction: under the conditions established by law, it allows the processing of data to be stopped, in such a way that NIS avoids its processing in the future, only keeping it for the exercise or defense of claims.
- Objection: in certain circumstances and for reasons related to the individual’s particular situation, data subjects may object to the processing of their data. NIS will stop processing the data, except for compelling legitimate reasons, or for the exercise or defense of possible claims.
- Portability: allows the data subject to receive their personal data and transmit it directly to another controller in a structured, commonly used, and machine-readable format. To exercise this right, the customer must provide a valid email address.
NIS guarantees the adoption of the necessary measures to ensure the exercise of these rights free of charge, requiring for such exercise the attachment of a copy of their official identification document and sending it through one of the following ways:

6. Information we share: recipients or categories of recipients
NIS will only share personal data with third-party recipients in the following cases:
- Necessary for service provision:
NIS belongs to a business group of other companies owned by the same shareholders where management of some of the functions necessary for service provision is carried out and may have access to personal data, acting as data processors and being contractually obliged to comply with their legal obligations as data processors, maintain the confidentiality and secrecy of the information.
- Communications of data to credit information systems:
The Client is informed that, in accordance with current regulations, in cases of non-payment, data related to the debt may be communicated to third-party companies duly legally authorized and responsible for managing non-compliance with monetary obligations.
- Compliance with a legal obligation:
NIS may also communicate to third parties duly legally authorized, your personal information when necessary to comply with the law.
NIS may communicate the Client’s personal data to various public authorities pursuant to a legal obligation, such as tax and customs authorities, judicial authorities, telecommunications authorities, judicial police, emergency call service providers 112, and any other authority that, according to current regulations, is applicable.
7. Security and confidentiality in the processing of your information
NIS will always treat user data absolutely confidentially and will maintain the duty of secrecy regarding them, in accordance with the provisions of the applicable regulations, adopting the necessary technical and organizational measures to ensure the security of your data and prevent their alteration, loss, processing, or unauthorized access, taking into account the state of technology, the nature of the stored data, and the risks to which they are exposed.
